Right of Withdrawal

A. Cancellation Policy

Introduction

Consumers are entitled to a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Bockauf Studio, Prinzenallee 58, 13359 Berlin, Germany, Email: shop@bockauf.studio) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same payment method that you used for the original transaction unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract.

The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling that was not necessary to examine the nature, characteristics, and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual choice or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal does not apply to contracts for the supply of alcoholic beverages whose price was agreed upon at the time the contract was concluded, but which can only be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on market fluctuations beyond the trader’s control.

The right of withdrawal expires prematurely in the case of contracts for the supply of sealed audio or video recordings or sealed computer software if the seal has been removed after delivery.

Unless otherwise agreed, there is no right of withdrawal for contracts relating to leisure activities if the contract provides for a specific date or period for performance. Accordingly, the right of withdrawal is also excluded for contracts concerning the sale of tickets for scheduled leisure events.

General Information

1. Please avoid damaging or contaminating the goods. Kindly return the goods in their original packaging with all accessories and packaging components. If necessary, please use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage using suitable packaging.

2. Please do not return the goods freight collect.

3. Please note that the above points 1–2 are not a prerequisite for the effective exercise of the right of withdrawal.
